In brief

  • 7,849,000 lei move from the budget of the Ministry of Education and Research into local budgets, to fit out sanitary facilities and connect them to utilities at 97 state pre-university education institutions.
  • 68 local authorities in 16 counties appear in the annex, 64 of them communes, 3 towns and one municipality. The money reaches them through the county school inspectorates, the ministry’s territorial branches.
  • Only schools already funded in 2025 under Government Decision no. 351/2025, where the works had not been carried out or completed by 31 December 2025, are included. This is not a new list of recipients, it is last year’s list run again.
  • The real deadline is 81 days. Whatever is not spent by the end of 2026 goes back to the state budget, under Article 2(3).
  • The smallest amount in the annex is 6,000 lei, the largest 186,000 lei, and half the entries are at or below 75,000 lei. The remaining costs, including the water and sewerage connections, stay with the local authority.
Act: Government Decision no. 808/2026 on the allocation of certain amounts from state budget transfers to local budgets, provided for in the budget of the Ministry of Education and Research, for the financing in 2026 of certain capital expenditure of state pre-university education institutions
Published: Official Gazette of Romania (Monitorul Oficial), Part I, no. 854 of 12 October 2026, pages 11-14
In force from: 12 October 2026, the date of publication, since the decision sets no later date in its text

The Government has allocated 7,849,000 lei for the toilets of 97 state schools and kindergartens that failed to finish their works in 2025. Government Decision no. 808/2026, adopted on 9 October 2026 and published three days later in the Official Gazette of Romania, Part I, no. 854 of 12 October 2026, opens no new programme. It runs last year’s list again, on money from 2026: the institutions that had received funding under Government Decision no. 351/2025 and where the works „had not been carried out or completed by 31 December 2025”.

The object could not be more concrete. The money goes on capital expenditure, meaning investment in buildings and installations rather than salaries or routine maintenance, and specifically on „continuing the works to fit out sanitary facilities and supply them with utilities”. In practice that means toilets moved from the yard into the building, running water, sewerage or a septic tank, electrical wiring and heating, in other words the works without which a school cannot obtain its health operating authorisation. The annex, a table by county and by institution, counts 97 entries allocated to 68 administrative-territorial units, that is 68 communes, towns or municipalities, in 16 counties. The annex and Article 1 express the amounts in thousands of lei, so the 7,849,000 lei appear in the act written as 7,849. The average amount per entry is 80,920 lei, the median is 75,000 lei, and 17 entries fall below 50,000 lei.

What it changes in practice

The decision produces three effects, all of them from the four paragraphs of Article 2. First: the amount is transferred to the local budgets of the administrative-territorial units listed in the annex, through the county school inspectorates. The school receives no money in an account of its own, the local authority does, and the inspectorate is merely the channel the money passes through. Second: the local public administration authorities are answerable, as provided by law, for the use of the allocated amounts, so procuring the works, the contract with the builder and the acceptance of the works are the responsibility of the mayor and the local council, not of the head teacher. Third: at the end of 2026 any amounts left unused are paid back to the state budget.

The fourth paragraph is technical, but useful to whoever keeps the local authority’s books: the amounts are recorded in the local budget on the revenue side, under indicator 42.02.14, „Financing of certain capital expenditure of pre-university education institutions”. Without amending the local budget on this indicator, the money cannot be committed, and that is the first step each of the 68 local authorities has to take.

The allocation is heavily concentrated. Mehedinți county takes 1,660,000 lei, that is 21.15% of the total, with 19 of the 97 entries. Vrancea follows with 986,000 lei and 18 entries, Vaslui with 910,000 lei and 13 entries, then Iași with 591,000 lei. At the other end, Buzău appears with a single entry of 33,000 lei and Giurgiu with one of 77,000 lei. Rural Romania dominates beyond appeal: 92 of the 97 entries are at schools in communes, and the only municipality on the list is Bacău, with a kindergarten.

What has changed compared with the previous situation

Until 12 October 2026, the 97 education institutions had no funding for the works left unfinished. The 2025 money did not carry over automatically into the following year: Government Decision no. 351/2025 contained the same rule on returning funds at the end of the budget year, so the unspent amounts went back to the state budget and resuming the works required a fresh allocation, from the 2026 budget line. That is why a separate decision was needed, and why the present amount is in practice funding from scratch for works begun two years ago.

The difference in scale shows if you line the allocations up. According to the explanatory memorandum published by the Ministry of Education and Research, the same capital expenditure line received 17,749,000 lei in 2021, 10,261,000 lei in 2022, 14,606,000 lei in 2023, 24,450,000 lei in 2024 and 14,589,000 lei in 2025. For 2026, the budget law provided 7,900,000 lei, of which the decision allocates 7,849,000 lei. The programme has not stopped, but the annual envelope has fallen to almost a third of the 2024 peak.

The entry criterion has changed as well. In previous years, the decisions named new institutions, identified as operating with toilets in the yard, without running water and without sewerage. Decision no. 808/2026 narrows the circle: only those who were on the 2025 list, did not finish the works and still meet the funding conditions in 2026. A school in the same situation that did not feature in Government Decision no. 351/2025 cannot enter this allocation.

Advantages and disadvantages

What it improves

  • Works abandoned halfway receive cover again, instead of staying open building sites in the school yard for an indefinite time.
  • The annex is nominal, by education institution and by exact amount, so any parent can check whether their child’s school is on the list and for how much.
  • The totals balance to the leu: the sum of the 97 entries and the sum of the 16 county totals come to exactly the 7,849,000 lei in Article 1, and the numbering by county has no gaps and no duplicates.
  • Responsibility sits clearly with the local authority, through Article 2(2), which spares head teachers public procurement procedures they have no way of running.
  • The repayment rule in Article 2(3) prevents public money being locked in a local account indefinitely.
  • The target is the health operating authorisation, so the effect is not cosmetic: a school without running water and without sewerage operates at the edge of legality.

What remains a problem

  • The execution window is 81 days, from 12 October to 31 December 2026, and it has to hold the local budget amendment, the public procurement, the works and the acceptance.
  • The money does not arrive in advance. Under the mechanism described by the ministry, the inspectorate transfers the amount at the local authority’s request, on the basis of the acceptance and the invoice, so the local authority has to pay for the works first out of its own money.
  • The decision lays down no reporting obligation. Nobody is bound to say, on 31 December 2026, how many of the 97 jobs were finished.
  • Small amounts do not cover a whole job. The 6,000 lei for a kindergarten in the commune of Corbița, Vrancea county, or the 11,000 lei for one in the commune of Ciulnița, Ialomița county, are top-ups, and the difference falls on the local budget.
  • Drinking water and sewerage connections, precisely the most expensive and slowest part, stay entirely with the local authority.
  • Nothing prevents a third round. A job not finished in 2026 either will need a new decision in 2027, with the same procedure from the start.

Practical advice

  1. Mayors in the annex: amend the local budget in the first few days. The amount enters on the revenue side under indicator 42.02.14, and without this entry you cannot commit the expenditure. Every day lost here comes off the 81 that are left until 31 December 2026.
  2. Check whether you still have a contract in force with the 2025 builder. If you do, the works can resume without a new procurement procedure. If you do not, work out the public procurement timetable realistically before you promise a completion date.
  3. Prepare the payment documents from the start. The transfer is made against partial acceptance or acceptance on completion of the works, payment statements and a tax invoice, so the file is built as you go, not in the last week of the year.
  4. Head teachers: ask the local authority in writing for the works timetable. Responsibility for the money lies with the local authority, but the health operating authorisation is issued in the name of the education institution, so the school bears the consequence of an unfinished job.
  5. If the amount in the annex is smaller than the cost estimate, say so now. The difference is covered from the local budget, and a local council decision taken in October is easier than a job halted in December.
  6. Parents can ask for the list. The annex is public and nominal. Ask at the local authority or at the county school inspectorate what amount was allocated for your child’s school and what acceptance date has been committed to.

Frequently asked questions

How much does a school on the list receive?
It depends on the entry. The smallest amount in the annex is 6,000 lei, the largest 186,000 lei, the average is 80,920 lei, and half the entries are at or below 75,000 lei. 23 entries exceed 100,000 lei, and 17 fall below 50,000 lei. The amount is written explicitly against each education institution, in the „Suma (mii lei)” column, Amount (thousand lei).
Does the money go to the school or to the local authority?
To the local authority. Under Article 2(1), the amounts are transferred to the local budgets of the administrative-territorial units listed in the annex, through the county school inspectorates. The school is the beneficiary of the works, not of the money. Procurement, the contract and the acceptance fall to the local authority, which is answerable under Article 2(2) for the way it uses the amount.
Can a school that does not appear in the annex be added to the list?
Not through this decision. Article 1 limits the funding to institutions that were funded in 2025 under Government Decision no. 351/2025 and whose works had not been carried out or completed by 31 December 2025. A school in the same factual situation, but absent from the 2025 list, needs a future decision, not a supplement to this one.
What happens to money left unspent at the end of the year?
It goes back to the state budget. Under Article 2(3), at the end of 2026 any amounts left unused are paid back to the state budget. There is no automatic carry-over into 2027, exactly as in 2025, and that is why a new decision was needed instead of an extension of the old one.
Which costs does the amount cover and which does it not?
It covers the continuation of the works to fit out the sanitary facilities and supply them with utilities, as capital expenditure. According to the explanatory memorandum of the Ministry of Education and Research, the amounts come as a top-up to the local budget, and the remaining costs needed for completion, including the drinking water and sewerage connections, are borne by the local authority’s budget.
How many institutions and how many counties appear in the annex?
97 entries, at 68 administrative-territorial units, in 16 counties: Argeș, Bacău, Botoșani, Buzău, Caraș-Severin, Călărași, Constanța, Dolj, Gorj, Giurgiu, Ialomița, Iași, Mehedinți, Olt, Vaslui and Vrancea. 64 of the 68 local authorities are communes. 19 local authorities appear with more than one entry, the heaviest being the commune of Dumitrești, Vrancea county, with 8 entries and 392,000 lei.
On what legal basis is the money given?
The preamble invokes Article 108 of the Constitution, Article 3 of the state budget law for 2026, Law no. 43/2026, and Article 144(1)(g) of Pre-university Education Law no. 198/2023. The last one is the one that counts: it allows the financing, by a Government Decision initiated by the Ministry of Education, of annual or multiannual programmes of investment and of development of the material base of state schools.

Editorial analysis

The figure that tells the story is not in the decision, it comes out of a comparison. The ministry’s explanatory memorandum shows that in 2025, through Government Decision no. 351/2025, 14,589,000 lei were allocated on the same capital expenditure line. The present decision allocates 7,849,000 lei for works from that same list, not started or not finished by 31 December 2025. The ratio is 53.8%: at least half of last year’s money never reached the walls. The real percentage is probably higher, because the list kept only those institutions that also meet the 2026 funding conditions and that confirmed, through the inspectorate, that they would continue the works. An execution rate below 50% on jobs worth a few tens of thousands of lei each is a matter of the administrative capacity of small communes, not of the size of the amounts, and the decision does not touch this point at all.

The second observation concerns time and shows only once the dates are put end to end. The reference point for non-performance is 31 December 2025. The ministry asked the county school inspectorates to check the situation by letter no. 383/GP of 7 May 2026. The decision was adopted on 9 October 2026 and published on 12 October 2026, 158 days after that request and 285 days after the reference date. The recipient is left with 81 days until 31 December 2026, and into them must fit the local budget amendment, the public procurement procedure, the execution and the acceptance. The administration took nine and a half months to draw up a list, and asks the local authority for a construction job in two and a half months. It is this imbalance, not the amount, that decides whether the money will be spent.

The third element concerns the mechanism. Unused amounts go, under Article 2(3), to the state budget at the end of the year, while the transfer itself is made, under the mechanism described by the ministry, at the local authority’s request, on the basis of the acceptance and the invoice. Combined, the two rules produce a result neither of them states on its own: the local authority pays for the works first out of its own money, in a stretch of time in which local budget execution closes at the end of the year anyway, and if it does not manage, the money goes back and everything starts again in 2027 with a new decision. For 19 of the 68 local authorities, which have several entries to handle at once, the pressure is multiplied. One more thing should be said in the act’s favour: its arithmetic is impeccable. We checked twice the sum of the 97 entries and the sum of the 16 county totals, and both come to exactly the 7,849,000 lei in Article 1, with no duplicate entry and no gap in the numbering, which is anything but usual in a four-page annex set out by county.

One check did come out against the drafting. We opened the state budget law for 2026, published in the Official Gazette of Romania, Part I, no. 242 of 27 March 2026, at Article 3, invoked in the preamble as the legal basis. The article has a single sentence and says that budget expenditure is set out in detail in the budgets of the principal authorising officers by source of financing, and within these by chapters, subchapters, paragraphs, titles, articles and expenditure items. It places the amount within the budget classification, but it gives the Government no power to allocate towards local budgets. That power comes from Article 144(1)(g) of Law no. 198/2023, also cited in the preamble, so the solution adopted by the act is untouched. The reference nevertheless remains a formal one, in the very place where a reader would look for the substantive basis. Also formal, but visible, is the name of the law: in the Romanian original the preamble writes „Legea bugetului de stat pentru anul 2026” instead of the official title, „Legea bugetului de stat pe anul 2026”. Both prepositions come out as „for” in English, so the slip is visible only in Romanian.

What should be changed

  1. A reporting obligation on 31 January 2027, entry by entry from the annex. The county school inspectorates already know what was transferred and against which documents. A public table reading „completed, in progress, not started” would show whether the programme works, something that today cannot be learned from any act.
  2. The allocation should be published in the first quarter, not in October. The data existed from 7 May 2026. A decision published in March or April would give the local authority a whole building season instead of 81 days that take in the start of winter as well.
  3. An advance of 30% of the amount on signature of the works contract. Payment strictly against acceptance turns state budget funding into credit granted by the recipient commune, and the communes with small budgets are precisely the ones that appear in the annex.
  4. Multiannual status for works in continuation. Article 144(1)(g) of Law no. 198/2023 expressly allows multiannual programmes. Using that option would end the cycle in which the same job calls for a new decision every year and stops on 31 December.
  5. Making the amount conditional on confirmation that the difference is covered from the local budget. At entries of 6,000 lei or 11,000 lei, without a local council decision showing the rest of the financing, the allocation risks being a transfer that goes back untouched to the state budget.
  6. The 51,000 lei left unallocated should be allocated, not left on the line. The budget law provided 7,900,000 lei on this item and the decision distributes 7,849,000 lei. The difference fully covers two of the smallest entries in the annex and has no reason to stay unused.
