1. Who runs this site
MonitorLegal.ro is operated by Emblematic Advertising SRL, a Romanian limited liability company with its registered office at Str. Pitar Moș nr. 27, et. 5, ap. 17, sector 1, Bucharest, postal code 010452, Romania, registered with the Trade Register under no. J2014003074128, tax identification number 33730699. The company is not registered for VAT.
You can reach us at contact [at] monitorlegal [dot] ro or on +40 742 456 404. In these terms, “we” means Emblematic Advertising SRL and “you” means anyone who uses the site or subscribes to its services.
2. The content is informational
MonitorLegal.ro is a legislative news publication. Our articles explain legal acts in plain language and do not constitute legal, tax or any other professional advice. For decisions with legal consequences, consult a qualified professional.
3. Sources and accuracy
Articles are based on texts published in the Official Gazette of Romania. We make every effort to be accurate, and at the end of each article we reproduce the original text of the act with its exact reference. Where our explanation and the official text differ, the official text prevails.
4. Intellectual property
The explanatory texts, the structure and the design of the site belong to MonitorLegal.ro. The official texts of legal acts are not subject to copyright under Romanian law. You may quote our articles with a link to the source; reproducing them in full without written consent is not permitted.
5. Available services
The site content and the weekly digest are free. The weekly digest is sent on Saturdays, covering the categories you choose, and can be stopped at any time using the link in the footer of every message.
The PRO subscription is a paid service that adds the daily digest, sent on working days, only when there is news on the topics you selected. Features announced as being in preparation on the subscription page are added to the subscription at no extra cost as they become available, but do not constitute a contractual obligation with a deadline.
6. Prices and payment
The PRO subscription costs 29 RON per month or 290 RON per year. Prices are stated in Romanian lei and are final; the company is not registered for VAT, so no VAT is added to these amounts.
Payments are processed by Stripe Payments Europe Ltd. on a secure page hosted by them. We never see, transmit or store your card details. To purchase a subscription you must give us the details required to issue an invoice: your full name and address if you are an individual, or the company name, tax identification number and registered address if you are a business.
The invoice is issued by us, separately from the payment, and sent to the email address on your account. Documents generated by Stripe are not tax documents.
7. How the contract is formed
The contract is concluded when the payment is confirmed by the payment processor and we activate PRO access on your account. You receive confirmation by email. No contract exists between us until the payment is confirmed.
We reserve the right to refuse or cancel an order in case of manifestly incorrect billing details, suspected fraud, or an obvious pricing error, with a full refund of any amounts collected.
8. Automatic renewal and termination
The subscription renews automatically at the end of each paid period, monthly or yearly, at the price in force at the time of renewal. You can stop it at any time yourself, from your account page, with a single click, without asking us and without giving a reason.
Stopping the renewal does not cut off access immediately: you keep the service until the end of the period you already paid for, after which the subscription ends at no further cost. We do not refund amounts pro rata for the remaining period, except in the cases set out in section 9 and where the service was not provided through our fault.
If we change the price, we will notify you by email at least 30 days before renewal, and if you do not agree you can stop the renewal before that date.
9. Right of withdrawal
If you are a consumer, you have the right to withdraw from the contract within 14 calendar days of its conclusion, without giving a reason and without penalty, under Romanian Government Emergency Ordinance no. 34/2014, which transposes Directive 2011/83/EU.
The exception that applies here: the PRO subscription is a digital service supplied immediately. If, at the time of purchase, you expressly request that supply begins before the 14-day period expires and you acknowledge that you thereby lose your right of withdrawal, that right is extinguished once the service has been fully supplied. The checkbox confirming this appears at checkout and is mandatory; without it we cannot start the service immediately.
If you did not give that consent, or if you wish to withdraw within the period, write to us at contact [at] monitorlegal [dot] ro. We will refund you within 14 days of being informed, using the same payment method, at no additional cost to you.
10. Your account
A PRO subscription requires an account. You are responsible for keeping your password confidential and for activity carried out through your account. If you suspect someone else has accessed it, tell us immediately.
We may suspend or close an account used to redistribute our content automatically, to resell it, or to disrupt the operation of the site, refunding the unused part of the subscription.
11. Service availability
We work to keep the site and the digests running without interruption, but we do not guarantee permanent availability. Short maintenance windows, incidents at our hosting or email providers and events of force majeure do not constitute a failure to perform the contract. If an interruption caused by us exceeds 7 consecutive days, we extend your subscription by the affected period.
The digest is sent only when there is news in the categories you selected. A day without an email is not a fault, it means no relevant legal acts were published for you.
12. Limitation of liability
We are not liable for decisions taken solely on the basis of our articles, for temporary unavailability of the site, or for the content of external sites we link to. Our contractual liability is limited to the amount you paid in the last 12 months. Nothing in these terms limits liability that cannot be limited by law.
13. Complaints and dispute resolution
Send any complaint to contact [at] monitorlegal [dot] ro. We reply within 30 days at the latest.
If we do not reach a solution, you may contact the Romanian National Authority for Consumer Protection (anpc.ro) or use the European online dispute resolution platform at ec.europa.eu/consumers/odr. You also have the right to alternative dispute resolution under Romanian Government Ordinance no. 38/2015.
14. Changes to these terms
We may update these terms; the current version, with the date it was updated, is permanently published on this page. Changes affecting an ongoing subscription are communicated to you by email at least 30 days before they take effect, and if you do not accept them you can stop the renewal.
15. Governing law
These terms are governed by Romanian law. Any disputes will be settled amicably or by the competent courts in Romania. If you are a consumer resident in another European Union member state, you also enjoy the protection of the mandatory rules of your own country’s law.
