A haulage company putting together its application for electric lorry funding has a single calculation to redo: the scheme budget and the aid ceiling are now converted into lei at the InforEuro rate for June 2026, not at the one for July 2025. Order no. 794/2026 of the Minister of Transport and Infrastructure, published in Official Gazette of Romania no. 702 of 25 August 2026, amends only two paragraphs of the state aid scheme approved last year. It is the second scheme of this kind in the ministry portfolio, alongside the one for electric vehicles for SMEs and passenger carriers.

The scheme concerned is the one approved by MTI Order no. 756/2025, published in Official Gazette of Romania no. 723 of 4 August 2025. It funds the purchase of zero-emission vehicles for road and rail freight transport, as well as for maritime and inland waterway transport of passengers and goods. The money comes from the Modernisation Fund, the European instrument financed from the sale of emission allowances.

A comparison with the original text shows exactly how small the intervention is: out of the whole of Article 13, which has seven paragraphs, two are rewritten, and in both the only substantive difference is the reference month of the exchange rate.

What it changes in practice

The first effect is the recalculation of the budget in lei. Paragraph (1) keeps the amount of EUR 299,000,000 and its nature, non-repayable funds from the Modernisation Fund, but moves the conversion benchmark to the InforEuro rate for June 2026.

The second effect is the recalculation of the ceiling per company. Paragraph (6) maintains the maximum aid value at EUR 18 million per undertaking and states separately that the leu equivalent is likewise calculated at the InforEuro rate for June 2026.

The third effect is in fact a drafting clarification. In the 2025 version, the reference to the exchange rate sat in brackets at the end of paragraph (6). It now becomes a sentence in its own right, which leaves less room for interpretation.

The fourth effect concerns procedure. The budget is still allocated by the provider through several successive competitive bidding procedures, until it is exhausted. The order does not change this mechanism.

The fifth effect is immediate. The order sets no deferred date, so the new rate applies from publication, that is from 25 August 2026.

What has changed compared with the previous situation

In the initial version of the scheme, published in Official Gazette of Romania no. 723 of 4 August 2025, paragraph (1) of Article 13 set the conversion at the InforEuro rate for July 2025, while paragraph (6) gave the same benchmark in brackets, „the leu equivalent at the InforEuro rate for July 2025”. This is the only substantive amendment made now.

What does not change is the amount. The scheme budget remains EUR 299,000,000, and the ceiling per undertaking remains EUR 18 million.

Nor does the breakdown by sub-measure change. The initial version allocated EUR 130,000,000 to sub-measure 1, EUR 90,000,000 to sub-measure 2 and EUR 79,000,000 to sub-measure 3, and the order does not touch paragraph (4).

The annual ceiling also stays as it was. Paragraph (5) provides that the average annual budget of the scheme does not exceed EUR 149,500,000, with a budget set separately for each competitive procedure.

The submission rule is unchanged too. Paragraph (7) allows a single funding application per annual call for one category of vehicles, and the total requested by the same undertaking in successive applications cannot exceed EUR 18,000,000.

Nor does the estimated number of beneficiaries change. Article 14 of the scheme still speaks of approximately 900 beneficiaries.

Advantages and disadvantages

What it improves

  • The conversion benchmark becomes a recent one, closer to the moment when applications are actually submitted.
  • The reference to the exchange rate comes out of the brackets and becomes a separate sentence in paragraph (6), so it is harder to miss when reading.
  • The amount in euro and the ceiling per company are untouched, so files already prepared do not have to be redone in substance.
  • The amendment is minimal and leaves the sub-measures, the timetable and the eligibility conditions alone.
  • Updating the exchange rate shows that the scheme is still active and that further bidding procedures are coming.

What remains a problem

  • The leu equivalent changes, so any project budget calculated on the July 2025 rate has to be redone.
  • The order does not say what the InforEuro rate for June 2026 is, so applicants have to look it up themselves.
  • There is no transition period for files already in preparation, the order applies from publication.
  • The scheme stays tied to a fixed rate rather than to the rate on the payment date, so currency differences remain with the beneficiary.
  • The order announces no timetable for the next competitive bidding procedure.

Practical advice

  1. Redo your project budget in lei using the InforEuro rate for June 2026. The InforEuro rate is published monthly by the European Commission and applies throughout the following month.
  2. Check whether the ceiling of EUR 18 million per undertaking is within your reach, bearing in mind that it accumulates across all applications submitted by the same company, not per call.
  3. If you already have a file in progress, update only the financial tables. The eligibility conditions and the required documents are not affected by this order.
  4. Follow the Ministry of Transport announcements on the next competitive bidding procedure. The budget is allocated in successive stages, until it is exhausted.
  5. If you are aiming at shipping or rail, check which of the three sub-measures your investment falls under, because the budget is broken down by sub-measure.
  6. Keep proof of the exchange rate used at submission. A file calculated on the old rate risks being found non-compliant at the financial check.

Editorial analysis

The problem the order solves is a real one, even if it looks like a technical correction. A scheme whose budget is expressed in euro but whose payments are made in lei needs a conversion anchor, and the anchor chosen in 2025 was the InforEuro rate for July of that year. In the meantime, the leu equivalent of the EUR 299,000,000 had stopped matching the sum in euro that the scheme promises, and so had the equivalent of the ceiling of EUR 18 million per undertaking. Moving the benchmark to June 2026 brings the two values back close to reality, without touching any of the eligibility conditions. The order also makes a second, quieter correction: in the 2025 version the reference to the exchange rate sat in brackets at the tail of paragraph (6), and it is now a sentence of its own, which takes it out of the category of reading detail.

The solution reproduces exactly the defect it repairs, though. The new benchmark is again a fixed rate from one particular month, and on the date the order was signed, 21 August 2026, it was already two months old, almost three by publication. Any movement of the rate over the coming months puts the scheme back where it has just come from, and the remedy will again be an order rewriting the same two paragraphs in order to change the name of a month. For an act applied through successive competitive bidding procedures, as the very paragraph (1) amended here provides, anchoring to a single date is the most fragile mechanism available.

What is genuinely missing is the transitional rule. Article II carries nothing but the publication clause, so the new rate applies from 25 August 2026 to a scheme in which the budget is allocated „până la epuizare”, until exhausted, in stages. If on the date of publication a procedure was open, or applications had been filed but not yet contracted, the text does not say whether they are recalculated. More importantly, the ceiling of EUR 18 million is checked cumulatively across all the applications of the same undertaking, and a company that received aid in a call converted at the July 2025 rate and then applies in one converted at the June 2026 rate ends up with two amounts in lei calculated on different benchmarks, which somebody has to add back together in euro in order to see whether the ceiling has been reached. The order does not say how.

What should be changed

  • A transitional clause instead of a bare publication rule. Article II ought to state expressly which rate applies to applications filed before 25 August 2026 and to procedures already launched. In practice, a company with a file under assessment would know whether it has to redo its financial tables or whether it stays on the rate applicable when it filed.
  • A rule for checking the cumulative ceiling. The scheme ought to say that the EUR 18 million per undertaking is checked by converting each contracted amount back into euro, at the rate applicable to the call in which it was granted. In practice, a beneficiary from two different calls would know exactly how much of the ceiling it has left.
  • A moving rate, tied to the call rather than to a fixed month. Paragraphs (1) and (6) could point to the InforEuro rate for the month in which each competitive bidding procedure is launched, stated in the call notice. In practice, no amending order would be needed every time the rate moves, and each call would have its own benchmark, known from the first day.
  • Publication of the amounts resulting from the conversion. The documentation for each call ought to carry the budget in lei, the ceiling in lei per undertaking and the breakdown by sub-measure, calculated at the applicable rate. In practice, the applicant would no longer have to reconstruct the state’s arithmetic alone from a monthly table published somewhere else.
  • A consolidated version of the scheme, published by the ministry. The annex to Order no. 756/2025 is now amended „cu modificările și completările ulterioare”, as subsequently amended and supplemented, so anyone who wants the current text has to rebuild it from several issues of the Official Gazette of Romania. In practice, it would be less likely for a file to be put together on an outdated version of the scheme.
  • Reporting of the outturn against the initial estimate. The scheme starts from an estimate of roughly 900 beneficiaries, and the ministry could publish, after each procedure, the number of contracts and the sums committed. In practice, it would be visible as things go along whether the budget is being used at the announced pace or whether the ceiling of EUR 18 million is concentrating the scheme in a few large files.
